1. Acceptance of Terms

By accessing or using the FDAUS Fabrication website ("Website") or engaging our fabrication, construction, or installation services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Website or Services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Website or Services constitutes acceptance of the revised Terms.

2. Services Description

FDAUS Fabrication provides custom outdoor living solutions including patios, carports, sheds, workshops, decking, fencing, gates, and outdoor entertainment areas in Perth, Western Australia.

All project details, specifications, timelines, and pricing are confirmed in writing via a formal quotation or contract. Verbal estimates or website information are indicative only and do not constitute a binding offer.

3. Quotes & Contracts

• All quotes are valid for 30 days from the date of issue unless otherwise stated.
• Quotes are based on information provided by the client and site conditions assessed at the time of quotation.
• Unforeseen site conditions (rock, asbestos, underground services, etc.) may result in variations to the quoted price.
• A signed contract and deposit are required to secure project commencement.
• Council approval, where required, is the client's responsibility unless explicitly included in the contract.

4. Deposits & Payments

• A deposit is required upon contract signing to secure materials and schedule works.
• Progress payments may be required for projects exceeding $10,000.
• Final payment is due upon practical completion of the project.
• Accepted payment methods: bank transfer, cash, or approved financing arrangements.
• Late payments may incur interest charges at the rate prescribed by the Australian Taxation Office.

5. Cancellation & Rescheduling

• Clients may cancel within 5 business days of contract signing for a full deposit refund (cooling-off period).
• Cancellations after the cooling-off period may forfeit the deposit, depending on materials ordered and work commenced.
• Rescheduling requests must be made at least 7 days before the scheduled start date.
• We reserve the right to reschedule due to inclement weather or unforeseen circumstances, with reasonable notice.

6. Warranties & Guarantees

• We provide a 10-year structural warranty on all fabrication work, covering defects in materials and workmanship.
• Manufacturer warranties apply to specific products (Colorbond, decking materials, etc.) and are passed through to the client.
• Warranties do not cover damage caused by misuse, neglect, unauthorised modifications, or extreme weather events beyond normal design parameters.
• Warranty claims must be submitted in writing within the warranty period.

7. Liability

To the maximum extent permitted by Australian Consumer Law, FDAUS Fabrication's liability for any loss or damage arising from our Services is limited to the value of the Services provided or the cost of rectifying defective work.

We are not liable for indirect, consequential, or incidental damages, including loss of profits, unless such liability cannot be excluded by law.

8. Intellectual Property

All content on this Website — including text, images, logos, designs, and project photographs — is the property of FDAUS Fabrication and is protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without prior written permission.

Custom designs prepared for your project remain our intellectual property until full payment is received, at which point the client receives a licence to use the design for the specific project only.

9. Website Use

• You agree not to use our Website for any unlawful purpose or in a way that could damage, disable, or impair it.
• You must not attempt to gain unauthorised access to any part of the Website or its systems.
• Information provided through our quote request form must be accurate and truthful.
• We reserve the right to suspend or terminate access to the Website for any user violating these Terms.

Our Website may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of use of any linked sites. Accessing third-party links is at your own risk.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Western Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.

12. Dispute Resolution

In the event of a dispute, both parties agree to first attempt good-faith negotiations to resolve the matter. If unresolved within 30 days, either party may refer the dispute to mediation through the Australian Small Business and Family Enterprise Ombudsman or seek resolution through the appropriate tribunal or court.

13. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, warranty, or other right under the Australian Consumer Law (ACL). Our goods and services come with guarantees that cannot be excluded under the ACL.
